GENERAL TERMS AND CONDITIONS OF SALE

 

These General Terms and Conditions of Sale and Use of the website (hereinafter the “GTC”) apply between:

 

Victoria Beaune SAS, a simplified joint-stock company with a share capital of €10,000, registered with the Paris Trade and Companies Register under number 988 696 423, whose registered office is located at 12, rue de Beaune, 75007 Paris (France), contact@victoriabeaune.com,

 

And

 

The “Client”, meaning any natural person of legal age acting exclusively for personal needs, who browses the website www.victoriabeaune.com (hereinafter the “Site”) and/or makes a purchase from Victoria Beaune (hereinafter the “Client” or the “User”).

 

Victoria Beaune requests that the Client carefully read this Contract (as defined below) before using the Site and/or placing any Order, as the Contract defines the Client’s rights and obligations.

Using the Site and/or placing an Order constitutes full knowledge and acceptance of the Contract by the Client.

If the Client disagrees with any of its provisions, they must refrain from using the Site or placing any Order.

 

Article 1. DEFINITIONS

 

    •    “GTC”: refers to these General Terms and Conditions of Sale detailing the sales, usage, and ordering conditions on the Site.
    •    “Client”: any natural or legal person placing one or more Orders.
    •    “Order(s)”: any firm order placed by the Client for the purchase of one or more Products available on the Site.
    •    “Content”: refers to all materials (texts, sounds, videos) published on the Site by Victoria Beaune and owned by it.
    •    “Personal Data”: any information relating to an identified or identifiable natural person, directly or indirectly, as defined by the GDPR.
    •    “Privacy Policy”: the document issued by Victoria Beaune describing the processing of Users’ Personal Data and defining their rights.
    •    “Product(s)”: refers to the jewellery items offered for sale by Victoria Beaune via the Site. All Products offered are new.
    •    “Customer Service”: the service provided by Victoria Beaune to answer Client requests regarding Products, orders, delivery, or after-sales support.
    •    “User”: any person, Client or otherwise, who visits or browses the Site.

 

Article 2. CONTRACT

 

Victoria Beaune may amend these GTC at any time. The Client must consult them regularly to stay informed of any updates. The latest version of the GTC will always be available on the Site. Any new version takes effect immediately upon publication and applies to all Orders placed from that date onward.

Any changes to the GTC made after an Order has been placed will not affect said Order or the relationship between the Client and Victoria Beaune, unless required by law.

Any Order placed on the Site constitutes a distance contract between the Client and Victoria Beaune and implies the irrevocable acceptance, without restriction or reservation, of the GTC applicable at the time the Order is validated.

 

Article 3. PRESENTATION OF THE SITE

 

The Site is published by Victoria Beaune SAS, a company with a share capital of €10,000, registered with the Paris Trade and Companies Register under number 988 696 423, domiciled at 12, rue de Beaune, 75007 Paris (France), contact@victoriabeaune.com.

 

Article 4. PRODUCTS

 

Victoria Beaune informs the Client that Product photographs may differ slightly from reality due to screen settings and lighting conditions.

As the Products are handcrafted, they may present variations, slight irregularities or differences in size or stone shades inherent to artisanal manufacturing. These shall not be considered defects. Victoria Beaune’s liability cannot be engaged and the validity of the Order cannot be affected.

Product photographs, graphics and descriptions are indicative only and do not bind Victoria Beaune. Clients may request further details from Customer Service.

 

Article 5. PRICES

 

Product prices are displayed in euros (€), all taxes included (VAT). Delivery fees are not included and are indicated separately at checkout.

Victoria Beaune may modify its prices at any time without notice. Products are invoiced based on the prices in effect at the time the Order is confirmed.

Orders shipped from France incur no customs duties for deliveries within the European Union.

For deliveries outside the EU, customs clearance, duties, and taxes are borne by the Client.

Payment of the full price is required at the time of the Order. Amounts paid cannot be considered deposits or down payments.

 

Article 6. ORDER

 

The Client declares that they:
    •    are at least 18 years old and legally capable of placing and fulfilling any Order, or hold parental authorization that they agree to provide upon request by Victoria Beaune;
    •    act as a consumer, meaning a natural person purchasing for personal use and not for professional purposes. All Orders must correspond to standard personal use.

After verifying the contents of the Order, the Client must confirm it during the payment step. This confirmation constitutes the conclusion of the contract.

The available languages for entering the Contract are French and English. In case of discrepancy, the French version prevails.

Products are manufactured once the Order is placed. Therefore, a production time applies.

Victoria Beaune reserves the right to refuse, cancel, or terminate any Order for legitimate reasons, including ongoing disputes regarding payment of a previous Order, suspicion of GTC violation, or attempted fraud.

 

Article 7. PAYMENT

 

Validating the Order implies the obligation to pay the indicated price. Payment may only be made by credit/debit card. Accepted cards are CB, MasterCard, Visa, and American Express.

During payment, the bank may request personal information to verify the identity of the cardholder. The Client must provide their card number, expiration date, and security code.

The Client guarantees that they are in good standing with the card issuer. The card is charged immediately.

The Order is confirmed only upon effective receipt of payment.

 

Article 8. DELIVERY

 

Products are delivered by La Poste, DHL or FedEx depending on the destination, to the address provided by the Client. Delivery areas include Metropolitan France and the European Union.

Any change of address by the Client may extend delivery times.

Any parcel returned due to an incorrect or incomplete address will be reshipped at the Client’s expense.

Delivery times begin upon sending the Order confirmation email and are indicative.

In case of a damaged or tampered parcel, the Client must refuse delivery and immediately notify Victoria Beaune, providing:
    •    a sworn statement confirming refusal due to damage,
    •    a valid ID copy,
    •    a recent proof of address (less than 3 months old).

Except in cases of force majeure, carrier-related issues, or Client fault:
    •    Made-to-order and Special Products are delivered within 4 to 6 weeks from the manufacturing confirmation email;
    •    In-stock Products are shipped within 5 business days (Products in stock are clearly indicated on the Site).

If the 4–6 week deadline is exceeded, the Client may request delivery within a reasonable additional period via registered mail with acknowledgment of receipt (LRAR).

If Victoria Beaune fails to deliver within this additional period, the Client may cancel the Order via LRAR, unless delivery occurs in the meantime.

Refunds are made within 14 days of cancellation.

In the event of abnormal delay, Victoria Beaune will notify the Client.

 

Article 9. RIGHT OF WITHDRAWAL & RETURNS

 

Standard Products :

The Client has 14 days from receipt to exercise their right of withdrawal without having to justify any reason (Articles L221-18 et seq. of the French Consumer Code).

The Client must email contact@victoriabeaune.com with the return request and a copy of the purchase invoice.

The Product must be returned simultaneously to:
Victoria Beaune, 12 rue de Beaune, 75007 Paris, France,
(postmark as proof).

Returns are effective only after Victoria Beaune sends written acknowledgment.

Returns are at the Client’s expense and must meet all conditions:
    •    Original condition
    •    Unworn
    •    Complete packaging
    •    Proof of purchase

Any Product showing scratches— even light ones— will be deemed non-compliant and cannot be refunded or exchanged.

Upon receiving the Product and verifying its condition, Victoria Beaune will refund the price within 14 days, provided the return is accepted.

Made-to-measure or personalized Products :

Such Products cannot be returned or exchanged according to Article L221-28 of the French Consumer Code.

 

Article 10. AFTER-SALES SERVICE (SAV)

 

In case of a defective Product, the Client may send it for after-sales service (SAV). Before shipping, the Client must email sav@victoriabeaune.com with:
    •    a photo of the damaged Product,
    •    proof of purchase,
    •    a description of how the damage occurred.

Victoria Beaune will confirm whether the Product is repairable or replaceable. The Client may then send it with the completed form.

Returns for SAV must provide proof of shipment (recommended mailing is advised). SAV returns are at Victoria Beaune’s expense.

If repairable, Victoria Beaune will return the Product within 3 to 4 weeks (except exceptional delays).
If repair is impossible, a replacement Product will be sent if available, or a refund issued.

These provisions apply only to genuine defects, not damage caused by improper handling or external impact.

 

Article 11. RESIZING

 

The Client has 30 days from delivery to request resizing.

They must notify Customer Service in writing beforehand, specifying the new size and following the provided return procedure. The request becomes valid only once acknowledged by Victoria Beaune.

Return, insurance, and reshipping costs are borne by the Client.

Once resized and received by the Client, the Product becomes non-returnable and non-exchangeable.
Resizing takes 4 to 6 weeks.

 

Article 12. LEGAL WARRANTY

 

Products benefit from:
    •    The legal warranty of conformity (Articles L217-3 et seq. of the French Consumer Code),
    •    The warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).

Requests must be sent to contact@victoriabeaune.com with the Order reference, the Product concerned, and a description of the alleged defect.

Damages due to external shocks, improper handling, or breakage of stones/pearls are not covered by the warranty. A paid repair estimate may be proposed.

Victoria Beaune makes no warranty regarding the Site or its content.

 

Article 13. LIABILITY

 

Except in cases of gross negligence, willful misconduct, or defective product liability, Victoria Beaune’s total liability is strictly limited to compensation of direct, material, foreseeable damages incurred by the Client.

Compensation may not exceed the price of the Client’s last purchase.

Indirect damages (loss of profit, turnover, data, image, etc.) are excluded.

Victoria Beaune cannot be held liable for damages arising from:
    •    Client fault,
    •    Force majeure,
    •    Third-party intervention (telecommunications issues, Client’s equipment, etc.),
    •    Any unforeseeable or unavoidable event.

The Client is responsible for ensuring equipment compatibility and appropriate security measures, including up-to-date antivirus protection.

The Site may contain links to third-party sites. Victoria Beaune declines any responsibility for their content or legality. The insertion of a link does not imply endorsement.

 

Article 14. INTELLECTUAL PROPERTY

 

The Site is owned by Victoria Beaune and protected by copyright law. All related intellectual property rights (texts, graphics, photographs, audiovisual works, designs, HTML developments, page layouts, logos, visual identity, etc.) belong exclusively to Victoria Beaune or are lawfully used by it.

The Client agrees not to infringe these rights in any way.

The Client may access the Content only for strictly personal and non-commercial use.

No Content may be copied, reproduced, modified, republished, uploaded, transmitted, or exploited without express written permission from Victoria Beaune.

Use of meta-tags or hidden texts containing the brand name without authorization is prohibited.

Creating hyperlinks requires prior written authorization and does not engage the responsibility of Victoria Beaune.

Framing or inline linking is strictly prohibited.

 

Article 15. PERSONAL DATA

 

Victoria Beaune collects and processes Personal Data in accordance with GDPR and French data protection laws.

Collected data is necessary for order processing and delivery.

The Client may exercise rights of access, rectification, erasure, restriction, opposition, and portability by emailing contact@victoriabeaune.com and providing ID.

With the Client’s explicit consent, data may be used for commercial offers or shared with partners. The Client may withdraw consent at any time via unsubscribe links or by email.

Victoria Beaune may use analytics tools and cookies to improve the Site. Data collected is anonymised.

Article 16. SPECIAL PRODUCTS

 

Special Products (custom-made, half-measure) cannot be exchanged or refunded (Article L221-28 of the French Consumer Code).
The contract is formed upon receipt of the signed Order form and full payment.

 

Article 17. APPLICABLE LAW & DISPUTE RESOLUTION

 

These GTC are governed by French law. In case of dispute, an amicable solution will be sought first. Failing that, the Client may refer the matter free of charge to a consumer mediator or to the competent French courts.

The competent courts are the courts of Paris (France).

 

Article 18. DIRECT SALES

 

Victoria Beaune may also sell its Products outside the Site, including at events, private sales or in showrooms.

Such sales are governed by these GTC unless stated otherwise at the time of sale.

When the sale is concluded off-premises (as defined by Article L221-1 of the French Consumer Code), the Client benefits from a 14-day right of withdrawal.
